1. Agreement to Terms

By accessing or using StampClub, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

These Terms constitute a legally binding agreement between you and StampClub.

2. Description of Service

StampClub is a digital loyalty platform that enables businesses to create and manage digital stamp cards, reward programs, and customer loyalty initiatives. Customers can collect stamps and redeem rewards through QR code scanning.

Our services include:

• Digital stamp card creation and management for businesses
• Customer-facing mobile web application for stamp collection
• QR code-based stamp collection system
• Reward and voucher management
• Business analytics and customer insights
• Push notifications and campaign tools

3. User Accounts

Business Accounts

• You must provide accurate business information
• You are responsible for maintaining account security
• You must be authorized to act on behalf of your business
• You may manage multiple locations under one business account
• You are responsible for the actions of your staff members
• You must be at least 18 years old to create a business account

Customer Accounts

• Accounts are free for customers
• You must provide accurate personal information
• You may not create multiple accounts to abuse rewards
• You must be at least 16 years old to create an account
• You are responsible for keeping your login credentials secure

4. Pricing and Payment

For Customers

Customer accounts are completely free. You will never be charged to collect stamps or redeem rewards.

For Businesses

• Payments processed securely via Stripe
• Cancel anytime with no cancellation fees
• No refunds for partial months
• Prices may change with 30 days written notice
• All prices shown exclude applicable taxes

5. Loyalty Program Terms

When participating in loyalty programs on StampClub:

• Rewards have no cash value unless explicitly stated by the business
• Rewards may expire according to the business's program rules
• Businesses reserve the right to modify or discontinue their programs
• Stamps and rewards are non-transferable between accounts
• Fraudulent stamp collection may result in account termination
• StampClub is not responsible for rewards provided by individual businesses

6. Acceptable Use

You agree NOT to:

• Use the service for any illegal purposes
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Create fraudulent loyalty programs or fake businesses
• Abuse the reward system through deception or automation
• Impersonate other users or businesses
• Collect stamps you are not entitled to receive
• Share, sell, or transfer your account credentials
• Use automated systems (bots, scrapers) without permission
• Upload malicious content, viruses, or harmful code

7. Intellectual Property

StampClub and its original content, features, and functionality are owned by StampClub and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content (logos, images, text) you upload to the platform. By uploading content, you grant StampClub a license to use, display, and distribute that content as necessary to provide the service.

StampClub integrates with the following third-party services:

• Clerk: Authentication and user management
• Convex: Database and backend infrastructure
• Stripe: Payment processing
• Resend: Email delivery

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

StampClub is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, StampClub and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the service
• Any unauthorized access to your account
• Any interruption or cessation of the service
• Actions of third parties or participating businesses

Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless StampClub and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination:

• Your access to the service will be revoked
• Any unclaimed rewards may be forfeited
• Business data may be retained as required by law
• You may request deletion of your data per our Privacy Policy

13. Dispute Resolution

Informal Resolution: Before filing a formal dispute, you agree to contact us at support@stampclub.app to attempt to resolve the dispute informally within 30 days.

Arbitration (US Users): For users in the United States, any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You waive any right to participate in a class action lawsuit.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after such changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
